Member Waiver

Monthly & Annual Memberships

This Waiver is for Monthly and Annual Memberships only. Tourist Memberships are subject to separate terms set out in Clause 5. Bookings for Wander with Nashy services are subject to separate terms set out in Clause 11.

By signing up for a Thriving Card membership, I confirm and agree to the following:

  1. I have read and agree to the Keep Edinburgh Thriving Membership Terms & Conditions, available to view below.
  2. I understand that my membership is a recurring subscription that will automatically renew; monthly at £6/month (Monthly Membership) or annually at £59/year (Annual Membership); unless I cancel before the renewal date.
  3. I understand that I can cancel my membership at any time via my account at Join It or by emailing hi@keepedinburghthriving.com and that cancellation will take effect at the end of my current billing period.
  4. I understand that I have a 14-day cooling-off period from today in which I can cancel and receive a full refund. I understand that if I add my Thriving Card to my wallet and use it to claim a Member Offer during this period, a proportionate charge may apply for services already received.
  5. I understand that Member Offers are provided by independent Participating Businesses and are subject to change. Keep Edinburgh Thriving does not guarantee the availability of any specific offer or the continued participation of any specific business.
  6. I confirm that my Thriving Card is for my personal use only and that I will not share, transfer or allow any other person to use my card or membership benefits.
  7. I understand that Keep Edinburgh Thriving (KET) Events &/or Thriving Fitness involving physical activity carry inherent risks. I confirm that I participate in any such activity at my own risk, that I am responsible for assessing my own fitness and suitability and that I will disclose any relevant medical conditions before participating. I understand that Keep Edinburgh Thriving may require me to complete a separate health screening form before certain activities.
  8. I have read and understood the Keep Edinburgh Thriving Privacy Policy available to view here. I understand how my personal data will be collected, stored and used, including that it will be processed by Join It (US-based, Standard Contractual Clauses apply) and Stripe.
  9. I understand that by allowing my membership to renew, I accept the version of the Terms & Conditions in effect at the time of renewal.
  10. I confirm that I am aged 18 or over, or that I have the consent of a parent or guardian to sign up for this membership.

Full Terms & Conditions

These Terms and Conditions (“Terms”) govern your membership of The Thriving Card and your booking of Wander with Nashy services, operated by Keep Edinburgh Thriving (“we”, “us”, “our”), the trading name of Thriving Media Ltd, a company registered in Scotland. By signing up for a membership and completing payment, or by booking and paying for a Wander with Nashy service, you agree to be bound by these Terms. Please read them carefully before joining or booking.

Keep Edinburgh Thriving is a community membership platform connecting members across Edinburgh and the Lothians with independent local businesses. We are based in East Lothian, Scotland.

Definitions

1.1“Membership” means a paid subscription to The Thriving Card, either on a monthly or annual basis. “Membership” also covers 7-day and 30-day Tourist Passes as well as Student.
1.2“The Thriving Card” means the digital membership card delivered to your Apple Wallet or Google Wallet upon activation of your membership.
1.3“Participating Business” means an independent business listed on the Keep Edinburgh Thriving directory that has agreed to offer exclusive discounts or offers to Thriving Card members.
1.4“Member Offer” means the exclusive discount or offer made available by a Participating Business to valid Thriving Card holders.
1.5“Monthly Membership” means a membership that renews automatically each calendar month at the monthly price.
1.6“Annual Membership” means a membership that renews automatically each year on the anniversary of your original sign-up date at the annual price.
1.7“Founding Member” means a member who joined under the limited Founding Member offer at £45 for their first year, subject to the specific terms set out in Clause 4.
1.8“Keep Edinburgh Thriving Event” means any event, activity, class, run club, walk, workshop, networking session or experience organised, hosted or co-hosted by Keep Edinburgh Thriving &/or Thriving Fitness whether delivered by Keep Edinburgh Thriving directly or in collaboration with a third-party provider or Participating Business.
1.9“Tourist Membership” means a non-recurring, fixed-term membership available as a 7-day pass or 30-day pass, designed for visitors to Edinburgh and the Lothians.
1.10“You” or “your” means the individual signing up for and holding a Membership, or the individual booking a Wander with Nashy service.
1.11“Wander with Nashy” means the suite of guided experience services operated by Keep Edinburgh Thriving, comprising: (a) “The Wander” – a 2 hour guided walk around Edinburgh with Nashy; and (b) “Plan Your Trip” – a 30 minute pre-trip video planning call with Nashy.
1.12“Wander Booking” means a confirmed booking for any Wander with Nashy service, formed when payment has been received and a date, start time and meet location have been agreed in writing (including by email) between you and Keep Edinburgh Thriving.
1.13“Booking Form” means the booking enquiry form hosted at tally.so, completed by you at the point of enquiry, which captures your details, the names and ages of all participants, and the consents required under these Terms.
1.14“Minor” means any participant under the age of 16 at the date of the Wander Booking.
1.15“Parent or Guardian” means the parent of a Minor or an individual with legal parental responsibility for a Minor, who must accompany the Minor for the duration of the Wander.

The Membership

2.1By completing sign-up and payment via our platform (powered by Join It and Stripe), you enter into a subscription contract with Keep Edinburgh Thriving for access to The Thriving Card and associated member benefits.
2.2Your Thriving Card will be delivered to your Apple Wallet or Google Wallet following successful payment. Instructions for adding the card to your wallet will be sent to your registered email address.
2.3The Membership is personal to you. You may not share, transfer, sell, or otherwise allow another person to use your Thriving Card or membership benefits.
2.4Your Thriving Card displays your name, membership type, and an expiry date. Participating Businesses are required to verify that the card is valid, including checking that the name on the Thriving Card matches the name on your payment card and that the expiry date has not passed, before applying any Member Offer.
2.5Membership provides access to Member Offers at Participating Businesses. These offers are set independently by each Participating Business and may change from time to time. We do not guarantee the availability, value or continued participation of any specific business or offer.
2.6We reserve the right to add or remove Participating Businesses and Member Offers at any time without prior notice.

Membership Pricing

3.1All prices are inclusive of VAT where applicable. Current pricing is displayed on our website and at the point of sign-up.
3.2We reserve the right to change our membership prices at any time. We will give you at least 30 days’ written notice of any price increase before it takes effect. If you do not wish to continue at the new price, you may cancel your membership without penalty before the new price comes into effect.
3.3Payment is processed securely by Stripe. We do not store your card details. By completing payment, you authorise Keep Edinburgh Thriving to charge your chosen payment method on a recurring basis in accordance with your chosen membership type.
4

Founding Member Terms

4.1The Founding Member offer is available to the first 250 members who sign up under the Founding Member tier only.
4.2Founding Members pay £45 for their first year of membership. The annual membership continues at the discounted annual rate of £45 per year as long as they remain a member. Members lose this privilege if they break their contract and then choose to rejoin, where they will have to pay the standard annual membership fee of £59. You will be notified 30 days and 7 days before each annual renewal.
4.3Founding Members receive a digital card with the title ‘Thriving Founding Member’ which remains theirs for the duration of an active and valid membership.
4.4Founding Member status is personal and non-transferable.
5

Tourist Membership Terms

5.1Tourist Memberships are available as a 7-day pass (£15) or a 30-day pass (£26). These are one-off, non-recurring payments.
5.2Your Tourist Thriving Card will be activated upon payment and will expire automatically at the end of the 7-day or 30-day period. No renewal or cancellation action is required from you.
5.3By completing your purchase, you expressly consent to the immediate delivery and activation of your Tourist Thriving Card. You acknowledge that once your digital card has been delivered to your Apple or Google Wallet, the service has been fully performed and your right to cancel under the 14-day cooling-off period (as set out in Clause 7) is lost, in accordance with Regulation 36 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
5.4Tourist Memberships are non-refundable once the digital card has been delivered to your wallet. If there is a technical issue that prevents delivery of your card, you are entitled to a full refund by contacting us at hi@keepedinburghthriving.com.
5.5All other Terms in this document apply to Tourist Memberships unless the context requires otherwise (for example, clauses relating to auto-renewal and the 14-day cooling-off period do not apply to Tourist Memberships).

Auto-Renewal

6.1Monthly and Annual Memberships are subscription contracts that renew automatically unless cancelled. Tourist Memberships do not auto-renew. Wander with Nashy bookings are one-off services and do not auto-renew. By signing up for a Monthly or Annual Membership, you acknowledge and agree to this recurring billing arrangement.
6.2Monthly Memberships renew automatically on the same date each calendar month. Annual Memberships renew automatically on the anniversary of your original sign-up date each year.
6.3We will send all members a regular membership newsletter by email (at least once per calendar month) which will include a standing renewal notice confirming that your membership renews automatically, the applicable renewal amount for your membership type and how to cancel if you do not wish to continue. Monthly Memberships will receive renewal reminders in their monthly payment confirmation emails. These newsletters and emails serve as your renewal reminders for Monthly Memberships. For Thriving Founding and Annual Memberships, we will additionally send a separate renewal reminder by email at least 30 days and 7 days before your annual renewal date.
6.4If you do not wish your membership to renew, you must cancel it before the renewal date in accordance with Clause 8 of these Terms.
6.5By allowing your membership to renew (whether automatically or by manual re-subscription), you accept the version of these Terms and Conditions in effect at the time of renewal. We will notify you of any material changes to these Terms in accordance with Clause 14 before your renewal date.
6.6Keep Edinburgh Thriving complies with the requirements of the Digital Markets, Competition and Consumers (DMCC) Act 2024 and will update these Terms as required when forthcoming subscription regulations come into force.

14-Day Cooling-Off Period and Refunds

7.1You have the right to cancel your membership within 14 days of first signing up (the ‘cooling-off period’) without giving any reason, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This right does not apply to Tourist Memberships, as you expressly consent to immediate performance and delivery of digital content at the point of purchase (see Clause 5.3). Separate cooling-off and cancellation rules apply to Wander with Nashy bookings as set out in Clause 11.
7.2By adding your Thriving Card to your wallet and using it to claim a Member Offer within the 14-day cooling-off period, you acknowledge that you have requested early performance of the contract. In this case, if you cancel within the cooling-off period, we are entitled to charge you a proportionate amount for the service provided up to the point of cancellation. We will refund the remainder.
7.3If you cancel within the 14-day cooling-off period and have not used your card to claim any Member Offer, you are entitled to a full refund of any amounts paid.
7.4To cancel within the cooling-off period, please contact us at hi@keepedinburghthriving.com with the subject line ‘Cancellation Request’, your full name, and your registered email address. You may also use the cancellation form in Part D of the Membership Agreement.
7.5Annual Membership renewals: you will also have a 14-day cooling-off period following each annual renewal, in accordance with the DMCC Act 2024. We will notify you of this right in your renewal reminder.
7.6Outside of the 14-day cooling-off period, we do not offer refunds on monthly membership fees already charged. For annual memberships cancelled mid-year outside the cooling-off period, we do not offer pro-rata refunds. Your membership will remain active until the end of the paid period.
7.7Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or any other applicable UK legislation.
8

Cancellation

8.1You may cancel your membership at any time. Cancellation can be completed online through your membership account at Join It or by emailing hi@keepedinburghthriving.com. Cancellation is always as simple as signing up. Cancellation rules for Wander with Nashy bookings are set out separately in Clause 11.
8.2Cancellation takes effect from the end of your current billing period. Your card will remain active until that date.
8.3You will not incur any cancellation charge or penalty for cancelling your membership at any time, subject to the terms of Clause 7 above regarding refunds.
8.4Following cancellation, your Thriving Card will be deactivated. The expiry date displayed on your card will reflect the end of your membership period.
8.5We reserve the right to cancel or suspend your membership if we reasonably believe you have: (a) provided false or misleading information at sign-up; (b) shared your membership card or benefits with a third party; (c) abused or misused the Member Offers; or (d) acted in a manner that brings Keep Edinburgh Thriving or its Participating Businesses into disrepute. In such cases, no refund will be due.
9

Member Offers and Participating Businesses

9.1Member Offers are provided by Participating Businesses at their sole discretion. We do not guarantee the availability, quality or value of any specific offer at any time.
9.2Keep Edinburgh Thriving acts as an intermediary between members and Participating Businesses. We are not responsible for the goods, services or experiences provided by any Participating Business.
9.3Any dispute regarding a Member Offer or goods and services of a Participating Business should be raised directly with that business in the first instance. Your statutory rights as a consumer are not affected.
9.4Participating Businesses may join or leave the platform at any time.
9.5Member Offers cannot be combined with other discounts or promotions unless expressly stated by the Participating Business.
9.6Each Participating Business is responsible for verifying the validity of your Thriving Card, including your name and the membership expiry date, before applying any Member Offer.
10

Events, Activities and Wellbeing

10.1Keep Edinburgh Thriving may from time to time organise, host or co-host events, activities, run clubs, walks, workshops, networking sessions, wellness sessions and other community experiences (“Keep Edinburgh Thriving Events or Thriving Fitness”) for members and the wider community. Keep Edinburgh Thriving Events / Thriving Fitness may be delivered by Keep Edinburgh Thriving directly, in collaboration with a Participating Business, or in partnership with a third-party provider.
10.2By attending or participating in any Keep Edinburgh Thriving Event &/or Thriving Fitness, you confirm that: (a) you are in good health and physically able to take part in the activity; (b) you have disclosed any relevant medical conditions, injuries, disabilities or allergies that may affect your ability to participate safely; and (c) you participate entirely at your own risk.
10.3Keep Edinburgh Thriving Events or Thriving Fitness involving physical activity (including but not limited to run clubs, walking groups, fitness sessions, yoga, outdoor activities and similar) carry inherent risks. You are responsible for assessing your own fitness and suitability for any activity before taking part. If you are unsure whether an activity is suitable for you, we recommend consulting your GP or a qualified medical professional before participating.
10.4Keep Edinburgh Thriving accepts no liability for any injury, illness, loss or damage arising from your participation in a Keep Edinburgh Thriving Event &/or Thriving Fitness, except where caused by our negligence or where it would be unlawful to exclude liability.
10.5Where a Keep Edinburgh Thriving Event &/or Thriving Fitness is delivered by or in collaboration with a third-party provider or Participating Business, that provider is solely responsible for their own risk assessments, health screening, participant registration, insurance and health and safety obligations. Keep Edinburgh Thriving does not collect health screening data on behalf of third-party providers and does not accept liability for the acts or omissions of third-party event providers.
10.6For Keep Edinburgh Thriving Events or Thriving Fitness delivered directly by Keep Edinburgh Thriving or its instructors, Keep Edinburgh Thriving may require participants to complete a separate health screening questionnaire, PAR-Q form or event-specific waiver before taking part. You agree to complete any such forms truthfully and in full. Failure to disclose relevant health information may result in you being unable to participate.
10.7Keep Edinburgh Thriving reserves the right to refuse entry to or remove any participant from a Keep Edinburgh Thriving Event &/or Thriving fitness if we reasonably believe their participation poses a risk to themselves or others.
10.8Keep Edinburgh Thriving Events &/or Thriving Fitness may be photographed or filmed for promotional purposes. By attending, you consent to the use of such images across Keep Edinburgh Thriving platforms unless you notify us in advance that you do not wish to be photographed.
10.9Keep Edinburgh Thriving Events &/or Thriving fitness are subject to availability and may be cancelled, rescheduled or modified at any time. Where a ticketed event is cancelled by Keep Edinburgh Thriving, a full refund will be issued for any event-specific fees paid.
11

Wander with Nashy

This clause sets out the terms that apply specifically to bookings for Wander with Nashy services: The Wander and Plan Your Trip. These are stand-alone service contracts and are separate from your Thriving Card Membership.
11.1 Services, Pricing and Group Size
11.1.1“The Wander” is a 2-hour guided walk around Edinburgh hosted by Nashy, including one drink stop at one venue (subject to Clause 11.6) where each participant receives one drink (a soft drink, hot drink or alcoholic drink at the participant’s choice, subject to the Alcohol Policy in Clause 11.6). Price: £200 for 1 or 2 adult participants; £50 per each additional adult participant; £20 per Minor (under 16). Maximum group size: 8 adult participants, plus accompanying Minors.
11.1.2“Plan Your Trip” is a 30-minute pre-trip video planning call hosted by a member of Keep Edinburgh Thriving. Price: £60 per call.
11.1.3All prices are inclusive of VAT where applicable and are subject to change. The price at the point of booking confirmation is the price that applies to your booking.
11.1.4Bookings that would exceed the maximum group size in Clause 11.1.1 may be declined or split into separate Wanders at our discretion. Where a booking is declined, any payment received will be refunded in full.
11.1.5During The Wander, where Nashy chooses to visit a Participating Business, the Thriving Card Member Offer at that business may be applied to additional purchases made by participants during the Wander, at Nashy’s discretion and subject to the Participating Business’s policy. The application of Member Offers during a Wander is a goodwill benefit only, is not guaranteed, and forms no part of the Wander service. Participants are not issued with a Thriving Card by reason of booking a Wander.
11.2 Booking, Payment and Contract Formation
11.2.1To book a Wander with Nashy service, you must complete the Booking Form at tally.so/r/9qRNyQ. Nashy or Abby will respond personally to confirm availability, date, start time and meet location.
11.2.2A Wander Booking is formed and becomes binding only when: (a) the Booking Form has been completed, including all required consents; (b) a date, start time and meet location have been agreed in writing between you and Keep Edinburgh Thriving; and (c) full payment has been received via the payment link sent to you.
11.2.3Full payment in advance is required to secure your booking. We do not hold provisional bookings without payment.
11.2.4Payment is processed securely by Stripe. We do not store your card details.
11.3 14-Day Cooling-Off Period (Wander with Nashy)
11.3.1You have the right to cancel a Wander Booking within 14 days of the date the booking is confirmed and payment is received (the ‘cooling-off period’) without giving any reason, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, subject to the exceptions set out below.
11.3.2By agreeing a Wander date that falls within the 14-day cooling-off period, you expressly request that performance of the service begins before the end of the cooling-off period. You acknowledge that if the Wander is performed in full before the end of the 14 days, you lose your right to cancel under the cooling-off period in accordance with Regulation 36 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
11.3.3If you cancel a Wander Booking within the 14-day cooling-off period before the Wander has taken place, and subject to Clause 11.4 below, you are entitled to a full refund.
11.4 Cancellation by You (Wander with Nashy)
11.4.1You may cancel or request to reschedule a Wander Booking by emailing hi@keepedinburghthriving.com.
11.4.2Cancellations or rescheduling requests made more than 48 hours before the agreed Wander start time will receive a full refund or, at your option, a rescheduled booking subject to availability.
11.4.3Cancellations made less than 48 hours before the agreed Wander start time are non-refundable. No refund will be issued for cancellations made within 48 hours of the agreed start time, including for non-attendance, late arrival, or any other reason. This applies regardless of the reason for cancellation, including illness, change of plans or travel disruption.
11.4.4We strongly recommend that you take out travel or booking insurance to cover the cost of your Wander in the event you are unable to attend.
11.4.5For Plan Your Trip calls, cancellations made more than 24 hours before the agreed call time will receive a full refund or a rescheduled call; cancellations made within 24 hours are non-refundable.
11.5 Cancellation by Us (Wander with Nashy)
11.5.1Wanders take place in all reasonable weather. Edinburgh’s climate is part of the experience and we will proceed in light to moderate rain and wind.
11.5.2If conditions are genuinely severe (for example, named storms, weather warnings issued by the Met Office at amber or red level, or other circumstances that we reasonably consider would put participants at risk), or if Nashy is unable to host the Wander for any other reason (including illness), we will contact you as soon as possible. In such cases, you will be offered a full refund or, at your option, a rescheduled booking subject to availability.
11.5.3We are not liable for any other costs you may incur as a result of a cancellation by us, including travel, accommodation or any other consequential losses. We strongly recommend appropriate insurance.
11.6 Alcohol Policy
11.6.1The included drink stop on The Wander may be a soft drink, hot drink, or alcoholic drink at the participant’s choice, subject to this Alcohol Policy and the policy of the host venue.
11.6.2Alcoholic drinks are strictly limited to participants aged 18 or over. No alcohol will be provided to or consumed by any participant under the age of 18 under any circumstances.
11.6.3Participants who appear under the age of 25 must produce valid photographic identification (passport, UK photocard driving licence, or PASS-accredited proof of age card) at the drink stop if requested. Nashy and the host venue both reserve the right to refuse to serve alcohol where valid ID is not produced or where there is any doubt as to the participant’s age. This is in line with the Licensing (Scotland) Act 2005 and the Challenge 25 policy operated by licensed premises.
11.6.4Where a participant is refused service of an alcoholic drink under Clause 11.6.3, they will be offered a soft drink or hot drink in its place. No refund will be made for the cost of the included drink in such cases.
11.6.5Nashy reserves the right to refuse to continue a Wander where a participant is, in Nashy’s reasonable opinion, unfit to continue due to intoxication, or where their conduct presents a risk to themselves, the group, the host venue, members of the public, or to the reputation of Keep Edinburgh Thriving. No refund will be due in such cases.
11.6.6Participants who choose to consume alcohol do so at their own risk and remain responsible for their own conduct, decisions and safe return home from the Wander.
11.7 Minors (Under 16s)
11.7.1Minors are welcome on The Wander at the rate of £20 per Minor. Minors do not count towards the maximum adult group size in Clause 11.1.1, but must be reasonable in number relative to the group of accompanying adults.
11.7.2Every Minor must be accompanied at all times during the Wander by a Parent or Guardian who is also a paying participant on the same Wander Booking. Nashy is not a childcare provider and at no point assumes sole care or supervision of any Minor.
11.7.3The Parent or Guardian is responsible at all times for the supervision, safety, conduct and welfare of any Minor in their care during the Wander, including on roads, in licensed premises, in public spaces and around any hazards.
11.7.4The Parent or Guardian confirms on behalf of each Minor that the Minor is in good health and able to participate and is responsible for disclosing any relevant medical conditions, allergies, mobility issues or other matters that may affect the Minor’s ability to participate safely.
11.8 Accessibility and Suitability
11.8.1Edinburgh’s terrain includes steep hills, cobbled streets, stairs and narrow spaces. Some areas of the city centre may present challenges for wheelchair users, those with limited mobility, or those with certain health conditions.
11.8.2If you have any accessibility, mobility, health or other requirements that may affect your ability to participate, you must contact us at hi@keepedinburghthriving.com before booking. We will discuss your needs with you and make reasonable adjustments to the route, pace or stops where we are reasonably able to do so, in accordance with the Equality Act 2010.
11.8.3You are responsible for assessing your own fitness and suitability for the Wander. We recommend wearing comfortable walking shoes and dressing appropriately for the weather.
11.9 Health, Safety and Conduct
11.9.1By participating in any Wander with Nashy service, you confirm that: (a) you are in good health and physically able to participate in a 2-hour walk; (b) you have disclosed any relevant medical conditions, injuries, disabilities or allergies; and (c) you participate entirely at your own risk.
11.9.2Nashy reserves the right to refuse to commence, or to terminate, a Wander where in Nashy’s reasonable opinion a participant is unfit to participate, is intoxicated, is behaving in a way that puts themselves or others at risk, or is being abusive or disrespectful to Nashy, the group, host venues or members of the public. No refund will be due in such cases.
11.9.3You are responsible for your personal belongings throughout the Wander. We are not liable for any loss, theft or damage to personal property.
11.9.4Liability for any Wander with Nashy service is subject to Clause 12 below.
11.10 Photography and Filming on Wanders
11.10.1Nashy may from time to time take incidental photographs or short video clips during a Wander for use on Keep Edinburgh Thriving’s social media channels and marketing materials. If you do not wish to appear in any photographs or video, please inform Nashy at the start of the Wander and reasonable efforts will be made to avoid featuring you.
11.10.2Where Minors are present, no photographs or video featuring the Minor will be used in public-facing content without the express prior consent of the Parent or Guardian. Parents or Guardians may give or withhold this consent via the Booking Form.
11.11 Data Protection (Wander with Nashy)
11.11.1Personal data collected via the Booking Form (including names, ages of participants, contact details, and consent records) is processed in accordance with Clause 13 and the Keep Edinburgh Thriving Privacy Policy.
11.11.2The Booking Form is hosted by Tally (tally.so), who acts as a data processor on our behalf.

Liability

12.1Keep Edinburgh Thriving’s total liability to you under or in connection with your Membership shall not exceed the total amount paid by you in the 12 months preceding the event giving rise to liability. Keep Edinburgh Thriving’s total liability to you under or in connection with a Wander with Nashy booking shall not exceed the total amount paid by you for that booking.
12.2We are not liable for: (a) any failure by a Participating Business to honour a Member Offer; (b) the quality or safety of goods or services provided by a Participating Business or any host venue visited during a Wander; (c) any loss or damage arising from your use of the Thriving Card; (d) any technical failure of Apple Wallet, Google Wallet, Tally, or our membership or booking platforms outside our reasonable control; (e) any injury, illness, loss or damage arising from your participation in a Keep Edinburgh Thriving Event &/or Thriving Fitness, except as set out in Clause 10; (f) any injury, illness, loss or damage arising from your participation in a Wander with Nashy, except as set out in Clauses 11 and 12.3; (g) the conduct or supervision of any Minor, which remains the responsibility of the Parent or Guardian at all times; or (h) any consequential losses arising from cancellation, rescheduling or non-performance of a Wander, including travel and accommodation costs.
12.3Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other matter where it would be unlawful to exclude or restrict liability.
12.4These Terms do not affect your statutory rights as a consumer.

Data Protection and Privacy

13.1Keep Edinburgh Thriving processes your personal data in accordance with the UK GDPR and the Data Protection Act 2018. We are registered with the Information Commissioner’s Office (ICO) C1893051.
13.2The personal data we collect from you includes: your name, email address, date of birth, payment information (processed securely by Stripe), and membership details. For Wander with Nashy bookings, we additionally collect the names and ages of all participants, contact details, dietary or accessibility requirements, and any consents recorded via the Booking Form. Where you participate in a Keep Edinburgh Thriving Event &/or Thriving Fitness, we may also collect health screening information provided by you. We collect this data to process your membership, deliver your Thriving Card, administer Wander Bookings, manage event participation, send membership communications and administer your account.
13.3We process your data on the lawful basis of contract performance (to deliver your membership or Wander Booking) and legitimate interests (to send relevant membership communications and improve our service). Health screening data collected for Keep Edinburgh Thriving Events &/or Thriving Fitness, and any photography or filming consents for Minors recorded via the Booking Form, are processed on the basis of your explicit consent.
13.4Your data is stored on servers operated by Join It (our membership management platform) and Tally (our Wander Booking platform), which are based in the United States. Both Join It and Tally transfer your data to the US under Standard Contractual Clauses (SCCs), which provide an appropriate safeguard for your personal data in accordance with UK GDPR requirements.
13.5We will not sell your personal data to any third party. We may share anonymised, aggregated data with Participating Businesses for the purpose of demonstrating the reach and impact of The Thriving Card.
13.6You have the right to: access your personal data; correct inaccurate data; request deletion of your data; object to processing; and withdraw consent where processing is based on consent. To exercise any of these rights, contact us at hi@keepedinburghthriving.com.

Changes to These Terms

14.1We may update these Terms from time to time. We will notify you of any material changes by email at least 30 days before the changes take effect.
14.2If you do not agree with the updated Terms, you may cancel your membership before the changes take effect without penalty.
14.3Your continued use of the membership after the effective date of any changes constitutes your acceptance of the updated Terms.
14.4By allowing your membership to renew (whether automatically or by manual re-subscription), you accept the version of these Terms in effect at the time of renewal.
14.5The version of these Terms that applies to a Wander Booking is the version in effect on the date the Wander Booking is confirmed.

General

15.1These Terms constitute the entire agreement between you and Keep Edinburgh Thriving in relation to your membership and any Wander with Nashy booking.
15.2These Terms are governed by the laws of Scotland. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the Scottish courts, without prejudice to your rights as a consumer under applicable UK law.
15.3If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
15.4We may assign our rights and obligations under these Terms to another organisation. We will notify you if this happens and ensure your rights are not affected.
Sign-Up Acknowledgement

Membership Agreement

This Membership Agreement sets out the key information you are confirming when you sign up for a Thriving Card membership or book a Wander with Nashy service. It forms the waiver and acknowledgement confirmed at the point of joining or booking.

Part A: Key Subscription and Booking Information

The following information is required to be presented clearly and separately to you before you enter into a subscription contract or service booking, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Digital Markets, Competition and Consumers Act 2024.

What you are signing up forA subscription to The Thriving Card; a digital membership card giving access to exclusive offers and discounts at independent businesses across Edinburgh and the Lothians. Or a booking for a Wander with Nashy service: The Wander or Plan Your Trip.

Monthly Membership price£6 per month, charged automatically each calendar month.
Annual Membership price£59 per year (or £45 for Founding Members in Year 1 only), charged automatically each year on your sign-up anniversary.
Student Membership price£29 per year, charged automatically each year. Requires a valid university email address and student ID for verification.
Tourist Membership price£15 for a 7-day pass or £26 for a 30-day pass. One-off payment, does not renew.
Wander with Nashy pricesThe Wander: £200 for 1 or 2 adult participants, £50 per each additional adult, £20 per Minor (under 16). Includes one drink stop with one drink per participant. Maximum group size: 8 adults plus accompanying Minors. Plan Your Trip: £60 per 30-minute call. One-off payment, does not renew.
This is a subscription. It auto-renews.Monthly and Annual Memberships will renew automatically unless you cancel before the renewal date. Tourist Memberships and Wander with Nashy bookings do not auto-renew. You will be charged the applicable amount on each renewal date without further action required from you.
How to cancel a MembershipYou can cancel at any time via your membership account at Join It or by emailing hi@keepedinburghthriving.com. Cancellation takes effect at the end of your current billing period. Cancellation is always as simple as signing up.
How to cancel a Wander BookingEmail hi@keepedinburghthriving.com. The Wander: more than 48 hours before the agreed start time, full refund or reschedule; less than 48 hours before, non-refundable. Plan Your Trip calls: more than 24 hours before the agreed call time, full refund or reschedule; less than 24 hours before, non-refundable. See Clause 11.4.
Renewal remindersYou will receive a regular membership newsletter (at least monthly) which includes a standing renewal notice confirming your auto-renewal, the amount and how to cancel. For Thriving Founder and Annual Memberships, you will also receive a separate renewal email reminder at least 30 days and 7 days before your renewal date. Monthly Memberships will receive a monthly update within each renewal confirmation email.
Your 14-day cooling-off rightFor Monthly, Annual, Student and Founding Memberships: you have 14 days from sign-up to cancel and receive a full refund. If you use your card to claim a Member Offer during this period, a proportionate charge may apply for services already used. Annual renewals also carry a 14-day cooling-off period. Tourist Memberships: by completing your purchase you consent to immediate delivery of your digital card and waive your right to the 14-day cooling-off period. Wander with Nashy bookings: 14-day cooling-off right applies but is waived if you agree a Wander date within the 14 days and the Wander is performed before the 14 days end. See Clause 11.3.
Your card and how it worksYour Thriving Card will be delivered to your Apple or Google Wallet. It displays your name, membership type, and expiry date. Participating Businesses will check the card name matches your payment card and that the expiry date has not passed before applying any offer.
Events and activitiesKeep Edinburgh Thriving may organise events, run clubs, walks and other activities. Participation is at your own risk. Separate health screening may be required for physical activities. See Clause 10 of the full Terms.
Wander with Nashy: key conditionsBookings via Booking Form at tally.so/r/9qRNyQ, full payment in advance. Minors (under 16) must be accompanied by a Parent or Guardian who is a paying participant. No alcohol for under-18s; ID required for any participant who appears under 25. Wanders proceed in all reasonable weather. Maximum group size 8 adults plus accompanying Minors. See Clause 11 of the full Terms.
What we cannot guaranteeMember Offers are set by independent businesses and may change at any time. We cannot guarantee the availability or continued participation of any specific business or offer. On a Wander, the application of Member Offers to additional purchases at participating venues is at Nashy’s discretion and is a goodwill benefit only.
Your dataWe collect your name, email, date of birth and payment details to manage your membership. For Wander Bookings, we additionally collect participant names, ages and consents via Tally. Your data is processed by Join It (US-based, Standard Contractual Clauses apply), Tally (US-based, SCCs apply) and Stripe. See our Privacy Policy here.
Terms renewalBy allowing your membership to renew, you accept the version of these Terms in effect at the time of renewal. The version of these Terms that applies to a Wander Booking is the version in effect on the date the booking is confirmed.
Governing lawThese Terms are governed by the laws of Scotland.

Part B: Member Acknowledgement & Agreement

The following statements must be confirmed by ticking the relevant boxes at the point of sign-up. By proceeding with payment, you confirm that you have read, understood and agree to each of the following:

  • I confirm that I have read and agree to the Keep Edinburgh Thriving Membership Terms & Conditions.
  • I understand that my membership is a recurring subscription that will automatically renew (monthly at £6/month for Monthly Membership, annually at £59/year for Annual Membership, or £29/year for Student Membership) unless I cancel before the renewal date.
  • I understand that I can cancel my membership at any time via my account at Join It or by emailing hi@keepedinburghthriving.com and that cancellation will take effect at the end of my current billing period.
  • (Monthly, Annual, Student and Founding Members) I understand that I have a 14-day cooling-off period from today in which I can cancel and receive a full refund. I understand that if I add my Thriving Card to my wallet and use it to claim a Member Offer during this period, a proportionate charge may apply for services already received.
  • (Tourist Membership only) I understand that by completing my purchase I am consenting to the immediate delivery and activation of my digital Thriving Card. I acknowledge that once my card has been delivered to my wallet, the service has been fully performed and I will no longer have the right to cancel under the 14-day cooling-off period. I understand that my Tourist Pass is non-refundable once delivered.
  • I understand that Member Offers are provided by independent Participating Businesses and are subject to change. Keep Edinburgh Thriving does not guarantee the availability of any specific offer or the continued participation of any specific business.
  • I confirm that my Thriving Card is for my personal use only and that I will not share, transfer or allow any other person to use my card or membership benefits.
  • I understand that Keep Edinburgh Thriving Events &/or Thriving Fitness involving physical activity carry inherent risks. I confirm that I participate in any Keep Edinburgh Thriving Event &/or Thriving Fitness at my own risk, that I am responsible for assessing my own fitness and suitability and that I will disclose any relevant medical conditions before participating. I understand that Keep Edinburgh Thriving may require me to complete a separate health screening form before certain activities.
  • I have read and understood the Keep Edinburgh Thriving Privacy Policy and understand how my personal data will be collected, stored, and used, including that it will be processed by Join It (US-based, Standard Contractual Clauses apply), Tally (US-based, Standard Contractual Clauses apply) and Stripe.
  • I understand that by allowing my membership to renew, I accept the version of the Terms & Conditions in effect at the time of renewal.
  • I confirm that I am aged 18 or over or that I have the consent of a parent or guardian to sign up for this membership.
  • (Student Membership only) I confirm that I am currently enrolled as a student at a recognised university or college in Edinburgh or the Lothians and that I have provided a valid institutional email address for verification. I understand that my student membership may be cancelled if I cannot evidence my student status.
  • (Founding Member only) I understand that my Founding Member price of £45 applies to my first year of membership and will continue to renew at this annual price as long as I remain a member. I will receive at least 30 days’ notice of this change before my first renewal.

Part B(ii): Wander with Nashy Booking Acknowledgement

The following statements must be confirmed by ticking the relevant boxes on the Booking Form at tally.so/r/9qRNyQ when booking any Wander with Nashy service. By proceeding with payment, you confirm that you have read, understood and agree to each of the following:

  • I confirm that I have read and agree to the Keep Edinburgh Thriving Terms & Conditions, including Clause 11 (Wander with Nashy).
  • I understand that my booking is a one-off service contract and that full payment in advance is required to secure the booking.
  • I understand that my booking is only confirmed once the Booking Form is complete, the date, start time and meet location are agreed in writing and full payment has been received.
  • I understand that I have a 14-day cooling-off period from booking confirmation, but that if I agree a Wander date within those 14 days I am expressly requesting early performance and may lose my cooling-off right once the Wander is performed in full.
  • I understand that cancellations are subject to Clause 11.4: for The Wander, cancellations made more than 48 hours before the agreed start time receive a full refund or reschedule and cancellations made less than 48 hours before are non-refundable; for Plan Your Trip calls, the same rule applies but at 24 hours. This applies regardless of the reason.
  • I understand that Wanders take place in all reasonable weather and that Keep Edinburgh Thriving will only cancel in genuinely severe conditions or where Nashy is unable to host.
  • I confirm that I am aged 18 or over, or that I have the consent of a parent or guardian to make this booking and to participate.
  • (Bookings including Minors) I confirm that I am the Parent or Guardian of each Minor on the booking, that the Minor will be accompanied by me at all times during the Wander and that I accept full responsibility for the Minor’s supervision, safety, conduct and welfare.
  • I understand and agree to the Alcohol Policy in Clause 11.6: no alcohol will be provided to any participant under 18 under any circumstances; participants who appear under 25 must provide valid photographic ID; and Nashy may refuse to continue a Wander where a participant is intoxicated or behaving inappropriately, with no refund due.
  • (Bookings including Minors, optional) As the Parent or Guardian, I give consent for incidental photographs or short video clips featuring the named Minor(s) to be used on Keep Edinburgh Thriving’s social media and marketing materials. If I do not give this consent, I understand that reasonable efforts will be made to avoid featuring the Minor in any public-facing content.
  • I confirm that I am in good health and physically able to participate in a 2-hour walk and that I have disclosed (or will disclose at booking) any relevant medical conditions, allergies, mobility issues or accessibility requirements.
  • I have read and understood the Keep Edinburgh Thriving Privacy Policy and understand how my personal data, including the data of any other participant or Minor on my booking, will be collected, stored and used, including that it will be processed by Tally (US-based, Standard Contractual Clauses apply) and Stripe.

Part C: Declaration

By completing payment and submitting your sign-up or Wander Booking, you confirm all of the above and enter into a binding subscription contract or service contract with Keep Edinburgh Thriving on the Terms set out in this Agreement and the full Membership Terms & Conditions.

You also confirm that: the information you have provided during sign-up or booking is accurate and complete; you are authorised to use the payment method provided; you understand that your Thriving Card will be issued to your Apple or Google Wallet at the registered email address you have provided and you accept that your statutory rights as a consumer are not affected by anything in these Terms.
